REGULATION FROM the 13th of April 2005, No. 214 “About confirmation of Rules of organization and fulfillment of works on Compulsory Communication Facilities Conformity Attestation”
According to the articles 41, 42 and 43 of the Federal Law “About Communication” the Russian Federation Government decrees:
1. To approve attached rules of organization and fulfillment of compulsory confirmation of communication facilities conformity.
2. To establish that compulsory attestation shall be made by the Ministry of Information Technologies and the RF Ministry of Communication Facilities to check conformity between communication facilities and requirements defined in the RF Standard Acts accepted before the 1st June 2003 and Standard Acts of Executive Power Federal Authorities in communication accepted before the 1st January, 2004

REGULATIONS
Of organization and maintenance of works on compulsory confirmation of communication facilities conformity
1. The present Regulations establish the order of compulsory attestation of communication facilities used in public networks as well as in technological and special communication networks (hereinafter referred to as communication facilities).
Communication facilities used in technological networks as well as in special communication networks are subject to compulsory communication in the part of their connection to public network.
2. The present Regulations use the following terms:
"Compulsory attestation of communication facilities conformity” – documenting of communication facilities conformity to technical regulations accepted in accordance with the RF legislation on engineering regulation and requirements stipulated in Standard Acts of the RF Ministry of Information Technologies and Communication concerning using these facilities (hereinafter referred to as fixed regulations) by their compulsory certification or acceptance of conformity declaration;
“Declarant” – a legal entity or an individual businessman who has accepted and registered a declaration of conformity according to the Present Regulations in the Federal Communications Agency;
“Holder of Certificate of Conformity” – a legal entity or an individual businessman to whom a certificate of conformity have been issued in established order;
“Applicant” - a legal entity or an individual businessman applied for making compulsory confirmation of communication facility conformity.
3. Communication facilities not included into the list of communication facilities that are subject to compulsory certification shall have declaration of conformity.
Declaration of conformity will be made by the declarant by declaration of conformity acceptance based on his own evidence and evidence from accredited testing laboratory (Center).
4. The RF Ministry of Information Technologies and communication:
- Accepts standard acts on using of communication facilities ;
- Defines the order of obligations observance control to provide conformity of delivered communication facilities to established requirements by holders of certificates of conformity and commitment declarants;
- Defines the order of maintenance of conformity certificate registries and declarations of conformity in communication;
- Approves an application form to fulfill compulsory certification of communication facilities,
- Confirms Forms of the Certificate of Conformity and Declaration of Conformity;
- Confirms testing methods;
- Publishes a list of specified requirements used to confirm conformity in industry printing.
5. Federal Communication Control Service:
- Controls observance of conformity between delivered communication facilities and specified ones by holders of Certificates of conformity and commitment declarants within the validity period of Certificates of Conformity and Declarations of Conformity;
- Issues instructions to the Holder of the Certificate of Conformity or declarant to delete discovered variance within the period not exceeding 90 days;
- Notifies the authority that issued the Certificate of Conformity as well as Federal Communication Agency that the Holder of the Certificate of Conformity or declarant failed to fulfill instructions to eliminate the variance.
6. Federal Communication Agency:
- Organizes certification system in communication including certification authorities and testing laboratories (Centers) regardless of their organizational and legal forms and form of ownership;
- Registers a Declaration of Conformity within 3 days from the date of its receipt and notifies an applicant during conformity declaring;
- Issues the registered declaration of communication facilities conformity to established requirements after receipt of the document of the state duty payment for registration of the Declaration of Conformity to the declarant;
- Stores the second copy of Declaration of Conformity registered in established order within its validity period and within 3 years from the date of its validity period expiration;
- Refuses to register the declaration in case of its incorrect drawing up or impossibility to make an identification based on the declarable communication facility technical description and sends a notification of refuse in the declaration registration including the reason of refuse within 10 days from the date of the decision making;
- Cancels registration of Declaration of Conformity in case of nonfulfillment of the Federal Service of Communication control instructions by the Declarant and failure to submit the document of the state duty payment for registration of the Declaration of Conformity within 50 days from the date of its registration;
- Registers forms of Certificates of Conformity;
- Terminates Certificates of Conformity issued by Authority that stopped its certification activity and if the holder of the Certificate of Conformity failed to fulfill the Federal Communication Service;
- Maintains registries of Certificates of Conformity and Declarations of Communication Certification System Conformity and publishes the information about entering of Certificates of Conformity and Declarations of Communication Certification System Conformity or deletion respectively in and from the specified registries;
- Considers complaints of applicants concerning wrongful acts of Certification Authorities and testing laboratories (centers).
7. Certification Authority:
- Accepts and examines an application for compulsory certification within the period not exceeding 30 days from the date of acceptance and informs the applicant of made decision;
- Identifies communication facilities submitted for compulsory certification and
- Selects specified requirements to make compulsory certification of these facilities for;
- Concludes contracts with applicants to fulfill works on compulsory communication facilities certification with information including name, content and quantity of the communication facility submitted for certification and testing terms;
- Concludes contracts with testing laboratories (centers) to make certification testing of communication facilities;
- Selects samples for testing;
- Makes solutions to issue Certificates of Conformity or to submit a reasonable refuse to issue based on testing results;
- Issues Certificates of Conformity and maintains the Registry of issued Certificates of Conformity;
- Sends attested copies of drawn up Certificates of Conformity of the communication certification system to the Federal Agency for their registration in the Certification of Conformity Registry in communication industry;
- Sends information of communication facilities failed to pass compulsory certification to Federal Service of Communication Control;
- Makes inspection control of certified communication facilities if it is provided by the compulsory certification scheme;
- Approves program to check possibility of manufacturer to produce communication facilities that correspond with specified requirements within the Communication Facility Certificate of Conformity validity period;
- Stops issued Certificates of Conformity validity in cases provided by the Russian Federation legislation;
- Provides for information on requests in cases provided by the Russian Federation legislation within its terms of reference;
- Provides applicants with information on the compulsory certification procedure.
8. Testing laboratory (Center):
- Makes Certification testing of communication facilities samples based on the contracts with Certification Authorities;
- Draws up minutes of the communication facilities certification testing results and submits them to the Certification Authority with which the contract has been concluded;
- Concludes contracts on communication facilities testing with applicants during declaration; draws up minutes based on the communication facilities testing results and sends them to the Declarant with which the contract has been concluded.
9. Seller, manufacturer or a legal entity or an individual businessman registered on the RF territory according to the RF legislation that provide conformity of delivered communication facilities with specified requirements may apply for compulsory certification.
A legal entity or an individual businessman registered on the RF territory according to the RF legislation that are manufacturers or provide conformity of delivered communication facilities with specified requirements based on contracts may be applicants during declaring of communication facilities conformity.
10. An applicant during conformity declaring:
- Selects specified requirements communication facilities correspond with;
- Concludes the contract with testing laboratory (center) to make testing;
- Submits testing sample of declared facilities, their description in Russian to the testing laboratory (center);
- Sends two copies of Declaration of Conformity to the Federal Agency for registration;
- Pays federal fee for registration made by the Federal Agency within the period not exceeding 60 days from the Declaration of Conformity registration date;
- Makes complaints in Federal Agency in case of wrongful acts of testing laboratories (centers).
11. Declaration of Conformity shall be drawn up in Russian and shall include:
- Name and location of the communication facility applicant and manufacturer;
- Technical description of communication facility in Russian;
- Written notification that communication facility end use will not destabilize the RF electric communication network integrity, consistency and safety;
- Information of research (testing) made according to specified order and of documents to provide communication facility conformity;
- Declaration of Conformity validity period.
12. Materials in support shall include own testing results drawn up as minutes and testing results from accredited testing laboratory (center) in the volume defined by specified requirements.
13. Declarant:
- Provides conformity of communication facilities with registered declarations of conformity with the specified requirements;
- Issues communication facilities that are subject to declaration of conformity after registration of declaration of conformity;
- Indicates information of registered declaration that confirms conformity of this communication facility with the specified requirements in passport and accompanying technical documentation;
- Stops communication facilities realization in case of the Declaration of Conformity validity period expiration or its termination;
- Suspends realization of communication facilities with the Declaration of Conformity in case these facilities samples do not correspond with the specified requirements; stores a copy of Declaration of Conformity registered in established order and materials in support within this declaration validity period and within 3 years from its validity period expiration date.
14. Declaration of Conformity registered in established order is valid for previously manufactured and marked communication facilities during their delivery (sales) within life time specified according to the RF legislation in case of liquidation, reorganization of the legal entity – declarant or of the state registration certificate validity termination for the citizen – individual businessman.
15. An applicant during compulsory certification:
- Sends an application for compulsory certification of communication facility that the applicant intends to certify including its technical description in Russian, technical characteristics to identify this communication facility and evaluate its conformity with the specified requirements to the Certification Authority accredited for communication facilities certification and if required:
- Submits additional information to the Certification Authority;
- Concludes the contract to fulfill compulsory certification with the Certification Authority;
- Submits a manufacturer’s document that confirms manufacturing fact of communication facilities declared for compulsory certification (in case the applicant is the seller) to the Certification Authority;
- Selects a scheme of compulsory certification;
- Provides the Certification Authority with possibility to select samples;
- Provides unchecked fulfillment of the Certification Authority representative powers;
- Makes complaints in Federal Agency in case of wrongful acts of Certification Authorities.
16. Technical description of communication facility shall include:
- Communication facility name, aim, complete and description of features;
- Software version (if any);
- Electrical (optical) characteristics;
- Radiation characteristics (for radio-electronic communication equipment);
- Operating conditions in public networks;
- Connecting field capacity (for communication equipment with switching system functions);
- Connection schemes to public networks with indication of realized interfaces, signaling protocols;
- Information of availability (lack) of in-built encryption means), receivers of global satellite navigation systems;
- Operating conditions including climate and mechanical requirements, placement methods and power supply types.
17. The following certification schemes are used in compulsory certification:
- Scheme No. 1 – is used to certify communication facilities upon the seller's application and provides for certification testing of samples taken from the seller and inspection checking of certified communication facilities within the Certificate of Conformity validity period. Certificate of Conformity is being issued for 1 year;
- Scheme No. 2 - is used to certify communication facilities upon the seller's application and provides for certification testing of samples taken from the manufacture and inspection checking of certified communication facilities within the Certificate of Conformity validity period. Certificate of Conformity is being issued for 1;
- Scheme No. 3 - is used to certify communication facilities upon the manufacturer's application and provides for certification testing of samples taken from the manufacture and checking the possibility of manufacturer to produce communication facilities that correspond with the specified requirements within the Certificate of Conformity validity period. Inspection testing is being made within the whole period of the Certificate of Conformity validity. Certificate of Conformity is being issued for 3 years;
- Scheme No. 4 – is used to certify a lot of manufactured communication facilities upon the manufacturer's or the seller’s application and provides for certification testing of samples taken from this lot. The Certificate of Conformity is drawn up with indication of identification features of communication facilities from this lot and is being issued for 3 years.
18. Compulsory certification shall be made within 3 months from the date of concluding of contract to fulfill works on compulsory certification. The period may be prolonged up to 6 months in case of complicated equipment certification.
19. Connection of communication facilities to public networks to make certification testing is made upon written consent of the communication operator whose network will be used for testing.
20. Testing laboratories (centers) check possibility of manufacturer to produce communication facilities that corresponds with specified requirements within the Certificate of Conformity validity period if it is provided in the certification scheme according to the program approved by Certification Authority.
21. Certification Authority makes a solution to issue or not issue a Certificate of Conformity after receipt of inspection testing results documents not later than 30 days.
22. In case of positive solution Certification Authority will draw up a Certificate of Conformity and send its attested copy to the Federal Communication Agency to register in the Registry of Certificates of Conformity of Certification System in communication.
23. Federal Communication Agency registers Certificate of Conformity in the Registry of Certificates of Conformity of Certification System in communication and notifies Certification Authority about this in writing or send a resonable refuse in registration.
24. Certification Authority within 10 days after receipt of written notification from the Federal Communication Agency on registration of the Certificate of Conformity issued to an applicant ….
25. Certificate of Conformity becomes valid from the date of its registration in the Registry of Certificates of Conformity of Certification System in communication.
26. Holder of Certificate of Conformity:
- Provides consistency with defined requirements to communication facilities with registered Certificates of Conformity;
- Indicates information on the Certificate of Conformity for the communication facility that is subject to compulsory certification in passport and accompanying technical documentation;
- Provides unchecked fulfillment of power by the Certification Authority representatives as well as persons who make inspection testing;
- Terminates communication facilities licence upon expiration of Certificate of Conformity validity period or upon termination Certificate of Conformity.
27. Certification Authority will make inspection testing of certified facilities if it is provided in the certification scheme.
28. Inspection tests shall be made not less than 1 time a year. Periodicity, terms and scope of inspection tests shall be defined in the program approved by Certification Authority and the Certificate of Conformity Holder.
29. Certification Authority will draw up an inspection testing conclusion on conformity or nonconformity between communication facility and specified requirements and notify the Holder of Certificate of Conformity about this.
30. Certification Authority will terminate the Certificate of Conformity if the communication facility doesn’t conform to established requirements or the Holder of the Certificate of Conformity violated the present regulations.
31. Certification Authority will terminate Certificates of Conformity within 30 days after notification from Federal Service of Communication Control and informs Federal Communication Agency about this in written form within 3 days.
32. Federal Service of Communication Control has the right to go to the law with a statement of forced withdrawal of communication facility in case Certification Authority failed to terminate validity of the Certificate of Conformity within 30 days after the notification receipt.
33. Certification Authority will terminate Certificate of Conformity and informs the Holder of Certificate of Conformity about this within 3 days in case of inconsistency discovered between communication facility and established requirements during inspection test.
34. Federal Agency excludes Certificate of Conformity from the Communication Certification System Registry of Certificates of Conformity within 10 days after receipt of written notification of the Certification Authority of the Certification of Conformity validity period expiration and publishes an information about this in industry printing.
35. The holder of the Certificate of Conformity or the Declarant shall indicate information of registered declarations of conformity and Certificates of Conformity that confirm that the holder of the Certificate or the Declarant guarantees communication facility conformity in the passport and accompanying technical documentation.
36. Communication facilities acquired within the communication facility declaration of conformity or certificate of conformity validity period can be used within the RF territory during the whole validity period of communication facility according to its field of application.

By order of FA TRM No. 7 dated July 22, 2004 both, the "Nomenclature of products and services (work) listed in normative documents of the Russian Federation, which are subject to compulsory certification" and the " Nomenclature of products whose conformity with applicable standards may be confirmed through issuance/ delivery of a certificate of conformity".
